To use the Service, you must create an account by providing a valid email address and password. You are responsible for maintaining the confidentiality of your account credentials.
You are responsible for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account or any security breach.
You must be at least 13 years old (or 16 in the European Union) to use the Service. By creating an account, you represent that you meet this age requirement.
Ownership: You retain all rights to the content you save to the Service, including links, text notes, and tags. We do not claim ownership of your content.
License to Us: By using the Service, you grant us a limited, non-exclusive license to store, process, and display your content solely for the purpose of providing the Service to you. This license terminates when you delete your content or account.
Your Responsibility: You are solely responsible for the content you save to the Service. You must ensure that your content does not violate any laws or infringe on the rights of others. We are not responsible for user-generated content.
The Service, including its design, features, functionality, code, and branding, is owned by SecondBrain and protected by copyright, trademark, and other intellectual property laws.

Key Points:
Paddle as Merchant of Record: All paid subscriptions are processed by Paddle.com Market Limited (for customers outside the United States) or Paddle.com Inc (for customers in the United States). Paddle is the Merchant of Record and authorized reseller for SecondBrain.
This means that when you purchase a subscription, you are purchasing from Paddle, but the Service is licensed to you by SecondBrain. By completing a purchase, you agree to both these Terms and Paddle's Terms and Conditions.
Important Notice for Digital Content: SecondBrain provides digital content and services that are made available immediately upon subscription. By subscribing and accessing the Service, you consent to immediate performance of this agreement and acknowledge that you will lose your right of withdrawal once you begin using the Service.
We offer different subscription plans with varying features and limits:
Paid subscriptions automatically renew until cancelled. You'll be charged between 00:00 and 01:00 (UTC) on the day the subscription period renews. We'll notify you if the price of a subscription increases and, if required, seek your consent to continue.
Cancellation: You can cancel your subscription at any time. Your cancellation will take effect at the end of your current billing period, and you will retain access to the Service until that date.
Downgrading: If you downgrade from Pro to Free:
14-Day Right of Withdrawal (For Consumers): If you are a consumer (purchasing for personal use), you have the right to withdraw from this agreement and receive a full refund within 14 days of purchase without giving any reason.
Important Notice: Your right to withdraw and receive a refund does NOT apply once you have started to use the Service. By accessing and using SecondBrain, you acknowledge that you will not be eligible for a refund.
Refunds: All refund requests are handled by Paddle (our payment processor) on a case-by-case basis. Paddle has the sole discretion to approve or deny refund requests.
If we cannot charge your payment method for any reason (such as card expiration or insufficient funds), we will attempt to notify you and retry the payment. If payment continues to fail and you have not cancelled your subscription, we reserve the right to suspend or cancel your subscription. You may reactivate your subscription by updating your payment method.
We strive to provide reliable service but do not guarantee 100% uptime. The Service may be temporarily unavailable due to:

You use the Service at your own risk. We do not warrant that the Service will meet your requirements or expectations.
You may delete your account at any time through your account settings. Upon deletion, your data will be permanently removed from our active database.
We reserve the right to terminate or suspend your access to the Service at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SECONDBRAIN AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:
This limitation applies whether the alleged liability is based on contract, tort, negligence, strict liability, or any other basis, even if we have been advised of the possibility of such damage.
Maximum Liability: In no event shall our total liability to you for all damages, losses, and causes of action exceed the amount you paid us in the twelve (12) months prior to the claim, or $100 USD, whichever is greater.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
You agree to indemnify, defend, and hold harmless SecondBrain, its affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to:
We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, and you agree to cooperate with our defense of such claims.
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which SecondBrain operates, without regard to its conflict of law provisions.
For International Users: If you are located outside of the service provider's jurisdiction, you will benefit from any mandatory provisions of the law of the country in which you are resident. Nothing in these Terms affects your rights as a consumer to rely on such mandatory provisions of local law.
Dispute Resolution: Any disputes arising from these Terms or the Service should first be addressed by contacting us at services.of.secondbrain@outlook.com. We will attempt to resolve disputes informally and in good faith. If informal resolution fails, disputes will be resolved through binding arbitration in accordance with applicable laws.
We reserve the right to modify these Terms at any time. When we make changes, we will update the "Last updated" date at the top of this page.
Your continued use of the Service after changes constitutes acceptance of the updated Terms. If you do not agree to the modified Terms, you must stop using the Service and may terminate your account.
